General

This website kapatours.com is owned and operated by KAPA TOURS E.E., having its registered office at DREPANO 21060 Greece, Greek Tax Identification Number 802001910, General Commercial Registry (G.E.MI.) number [GEMI NUMBER], [tourism registration/notification number, where applicable], email info@ kapatours.com and telephone +30 697 760 6328, hereinafter referred to as the “Company”.
Use of this website and the completion of any booking through it are subject to acceptance of these Terms of Use and Booking Conditions and the applicable Cancellation Policy.
Customers should read these terms before completing a booking.

Services

The website enables customers to obtain information about and book tourism-related services, including, by way of example, tours, excursions, activities, transfers and other related services.
The description, duration, meeting or departure point, date, time, price, inclusions, participation requirements and any other material characteristics of each service are displayed on the relevant booking page.
Customers are responsible for ensuring before booking that the selected service meets their requirements.

Booking process

To complete a booking, the customer selects the relevant service, date and, where applicable, time, number of participants or passengers and any additional options and provides the information necessary to provide the service.
Before the booking is finally submitted, the main characteristics of the service and the total price payable are displayed.
A booking is considered completed once the booking process has been successfully completed and the Company has issued a booking confirmation to the email address provided by the customer.
Customers are responsible for ensuring that all information provided during the booking process is accurate

Prices & payment

Prices are displayed in euros (€), unless stated otherwise, and include applicable taxes and charges unless an additional charge is clearly disclosed before the booking is completed.
The total amount payable by the customer will be displayed before payment.
Payment is made through the payment methods made available during checkout.
The Company is not responsible for additional charges imposed independently by banks, card issuers or currency conversion providers and not collected by the Company.

Customer obligations

Customers must:
• provide accurate and complete information when booking;
• arrive at the specified meeting or pick-up point at the stated time;
• follow reasonable instructions given by Company staff, drivers, guides or service providers;
• inform the Company in advance of any special requirements that may affect the provision of the service; and
• hold any required travel or official documentation.
Late arrival or failure to attend may be treated as a “no-show” in accordance with the Cancellation Policy.

Booking amendments

Requests to change the date, time, number of participants or other booking details are subject to availability and the nature of the relevant service.
Acceptance of an amendment is not guaranteed and a change may result in a price adjustment.
Where specific amendment conditions are clearly disclosed for a particular activity or service before booking, those specific conditions shall apply to that service.

Cancellations Policy

Bookings are subject to the Company’s Cancellation Policy, which forms an integral part of these Terms and is made available on the website and during checkout.
By completing a booking, the customer confirms that they have reviewed and accepted the Cancellation Policy.

Right of withdrawal

Customers are informed that the general 14-day right of withdrawal applicable to certain distance contracts does not apply where a statutory exception is applicable.
In particular, services related to leisure activities to be provided on a specific date or during a specific period may fall within a statutory exception to the right of withdrawal.
In such cases, the customer’s right to cancel a booking and receive any refund is governed by the Cancellation Policy accepted before the booking is completed.
Nothing in this section limits any mandatory consumer right granted under applicable law.

Changes or cancellation by the Company

The Company may amend or cancel a service where necessary due to circumstances including adverse weather conditions, safety considerations, restrictions imposed by public authorities, strikes, transportation problems, unavailability of a service provider or other circumstances that make performance impossible or unsafe.
Where the Company cancels a service, the customer will, as applicable, be offered the choice between:
(a) moving the booking to another available date or equivalent service; or
(b) receiving a refund of the amount paid for the cancelled service.
This does not affect any additional rights the customer may have under mandatory applicable law.

Third-party service providers

Certain services may be provided wholly or partly by third-party service providers.
Where specific third-party conditions apply, customers will be informed before completing the booking.
Nothing in this section excludes any liability of the Company that cannot lawfully be excluded.

Liability

The Company shall provide the booked services in accordance with the characteristics and conditions communicated to the customer at the time of booking.
The Company shall not be responsible for losses or damages resulting exclusively from acts or omissions of the customer or from circumstances that cannot reasonably be attributed to the Company.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

Personal data

Personal data processed in connection with use of the website and bookings is handled in accordance with the Company’s Privacy Policy, available on the website.

Complaints and contact

Customers may contact the Company regarding any issue with a booking or service at:
Email: info@kapatours.com
Telephone: +30 697 760 6328
Address: DREPANO 21060
The Company will make reasonable efforts to resolve complaints promptly and amicably.

Governing law

These Terms are governed by Greek law.
The choice of Greek law does not deprive consumers residing in another country of any mandatory consumer protection afforded to them under the law applicable to their circumstances.
Any dispute shall be subject to the courts having jurisdiction under the applicable rules on jurisdiction and consumer protection.

Changes to these Terms

The Company may amend these Terms in relation to future bookings.
Each booking shall be governed by the version of the Terms that was applicable and made available to the customer at the time the relevant booking was completed
